A personal injury claim against you, typically asserts that you owed the injured party a duty of care and that you breached that duty and it resulted in an injurious outcome for him or her. To defend a personal injury claim, you will try to show that you did not meet one of the requirements of the plaintiff’s claim. 2. Take pictures, and hold on to evidence.

Every case is unique. Memories are corrupted and compromised in an infinite number of ways, pictures can tell the tale of what happened. Make sure your photos show the weather conditions; the amount of traffic; the appearance of all persons involved in the injury; and the physical damage caused. This will help protect the integrity of your case.

3. If possible, get a police report.

This simple report contains so many important details, you cannot afford to be without it.
