One of the main gun charges is carrying a loaded firearm in a public place or in a vehicle. Usually this gun charge is a misdemeanor, unless other factors come into play it can be charged as a felony. Factors such as a prior felony conviction, a prior gun charge in California or you are not legally able to own a gun. In some cases a person can be exempt from this gun charge if they are a peace officer, active military personnel or even an authorized security guard.
Another common gun charge is possession of an illegal firearm, also a wobbler charge. Meaning the judge can sentence the defendant as a misdemeanor or a felony. There are over 50 Illegal firearms which includes assault weapons such as AK series rifles, Uzis and AR-15 series semiautomatic rifles. If charged as a misdemeanor the sentence can be up to one year in jail, if charged as a felony the sentence can be up to three years in county jail.
