If you commit a crime because you reasonably believe your life is in immediate danger, California law excuses your criminal conduct. “Duress” excuses criminal culpability when you only commit the crime because another person’s threats or
menacing actions compel you to do so. But there’s one crime that duress does not excuse: California Penal Code 187 murder. You may not kill another person to save your own life unless it is in self-defense. If, however, you commit a felony because of duress and you accidentally or negligently kill someone during the commission of that felony… California’s felony-murder rule would not be triggered. This means that you would not automatically be held criminally liable for that murder.
