California Motorcycle Law Basics
Motorcyclists are one of the most at-risk drivers on the road. Without having the protection of a vehicle’s frame and airbag system, they have a far greater potential of harm if involved in an accident. Motorcyclists should be aware of and follow California laws made for passenger vehicles and also laws made specific for motorcyclists. Following these laws will help reduce the risk of an accident, injuries, or even death.
California requires all motorcyclists to acquire a learner’s permit before applying for a license. A permit prohibits motorcyclists from carrying passengers, driving on the freeway, and driving at night. These permits are only good for twelve months after the issue date.
If under twenty-one years of age a rider must have a permit for six months before applying for a license. A motorcyclist must pass a vision exam, skills test, and a knowledge test covering information found in the California motorcycle handbook. Also, if under the age of twenty-one, a rider must pass a California Motorcyclist Safety Program training course that is conducted by the California Highway Patrol.
California has many laws for motorcyclists including regulations for equipment riders wear. Equipment such as helmets. Motorcyclists are required to wear a helmet at all times and must be in compliance with the standards of the U.S. Department of Transportation.
Motorcycles themselves also have regulations. Motorcycles must be equipped with both right and left mirrors and must have right and left turn signals for both the front and rear of the bike. The handlebars may not be more than six inches above the riders shoulder height. Any motorcycles built from 2013 and newer have to be compliant with the Motorcycle Anti-Tampering Act. This law requires exhaust systems to display approved EPA approval stickers or stampings.
Often, we see motorcyclists coming through in the middle of vehicles, which is referred to as “splitting lanes”. This can be an extremely dangerous maneuver. California has come up with some laws to help protect riders during this maneuver. One prohibits motorists from driving too slow that it blocks the reasonable movement of traffic. Another law makes it illegal for motorists to open or leave open vehicle doors unless it is safe to do so and does not interfere with the movement of traffic.
