In order to condemn a property owner or employer responsible for a slip and fall accident, you must prove their negligence is in fact what caused the injury. Did the hazardous condition remain for an extended period of time, long enough that an owner or employee could have taken precautions and removed the hazard before it became a dangerous accident?
Was there poor lighting in the area, or something causing an obstruction of view of the hazardous area?
Did the owner or employee have a process in place to have routine checks for potential hazards and if one is set in place do they have a log sheet in order to prove this process?
Was there any signs put in place to properly advise of the potential hazard, or an attempt to block the area and restrict entrance?
Possible circumstances a defendant can consider is:
Were there sufficient signs place in proper view to warn of the potential hazard?
Was the plaintiff preoccupied and failed to notice the properly placed warning signs? Such as texting/talking on the phone.
Was the plaintiff in an area where they would be considered trespassing and/or ignored signs of access denied?
Was the potential hazard present only for a short period, not allowing ample time to set up precautions or proper signage?
Was the process in place utilized properly by the owner or employees? If so, is there a properly documented log to prove such?
