The pedestrian does not always have the right of way. Just as drivers have rules and responsibilities, so do pedestrians. Pedestrians must be crossing within marked lines of a crosswalk. If a pedestrian is outside of the lines in a crosswalk or at an unmarked crosswalk at an intersection, they are to yield the right of way to the motorists.

Pedestrians do have the right away in controlled intersections and marked crosswalks. Vehicles have to yield the right of way to crossing pedestrians. When at a traffic light intersection pedestrians only have the right of way when the crosswalk signal says “walk”.  If the light does not give them the go-ahead, they must wait until the light changes and gives them the right of way to cross.

In most pedestrian-involved accidents the fault and liability fall on the driver. Most accidents are caused by:

  • Distracted driving
  • Disregarding traffic lights
  • Driving under the influence of drugs/alcohol
  • Not yielding the right of way to pedestrians

With a growing population, even in California alone, pedestrian accidents are on the rise. Many times these accidents cause terrible injuries or death, which could result in high medical bills.
